By downloading, installing, or using the NearBy mobile application ("App") or visiting our website at nearbyplaces.tech ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

NearBy is a mobile application that helps users discover nearby places including restaurants, cafes, attractions, and other points of interest. The App provides:

• Place search and discovery with advanced filters
• Interactive map views with custom markers
• AI-powered travel guide and recommendations
• Travel planning tools
• Place saving and bookmarking

To access certain features, you may need to create an account. You are responsible for:

• Maintaining the confidentiality of your credentials
• All activities that occur under your account
• Providing accurate and up-to-date information
• Notifying us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

NearBy offers a free tier with limited features and a premium subscription ("NearBy Pro") that unlocks additional functionality including:

• AI Travel Guide
• Visual Search
• Travel Planner
• Unlimited Saved Places

Subscriptions are billed through Google Play. Prices are displayed in the App before purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

Refunds are handled according to Google Play's refund policies.

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer or decompile the App
• Scrape, crawl, or extract data from our services
• Interfere with or disrupt the App's infrastructure
• Impersonate another person or entity
• Upload malicious content or spam
• Use the AI features to generate harmful or misleading content

The App, including its design, code, content, logos, and trademarks, is owned by NearBy and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Place data, photos, and reviews displayed in the App are sourced from Google Places and are subject to Google's terms of service.

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that:

• The App will be uninterrupted or error-free
• Place information is always accurate or up-to-date
• AI recommendations are always correct
• The App will meet all your requirements

Always verify important information (opening hours, prices, availability) directly with the place before visiting.

To the maximum extent permitted by law, NearBy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, or profits.

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by updating this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law provisions.
