Terms of Service

By downloading, installing, or using the NearBy mobile application ("App") or visiting our website at nearbyplaces.tech ("Website"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

NearBy is a mobile application that helps users discover nearby places — restaurants, cafes, attractions, and other points of interest — through three primary surfaces:

• Discover: personalized swipe-deck and map views with filters, saved places, and recently viewed collections
• Assistant: a conversational AI that plans trips, recommends places, explains options, and learns your preferences over time
• Travel tools: trip planner, hotel and flight search, day-by-day itineraries, and event discovery

To access certain features — including the Assistant, saved places, and chat history — you must create an account. You are responsible for:

• Maintaining the confidentiality of your credentials
• All activities that occur under your account
• Providing accurate and up-to-date information
• Notifying us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

The Assistant remembers preferences you share with it and uses them to tailor future replies. You can ask the Assistant to forget any preference at any time, or clear your full profile from Settings.

The Assistant's responses are generated by artificial intelligence. While we ground answers in real place data, AI output can still be incorrect, outdated, or incomplete. You are responsible for verifying critical information (opening hours, prices, availability, accessibility) directly with the place before visiting or transacting.

You agree not to use the Assistant to generate harmful, illegal, deceptive, or harassing content, or to attempt to extract its internal instructions or training data.

If you opt in, NearBy may occasionally send push notifications with place suggestions based on your activity and preferences. You can disable notifications at any time from device settings or the App's Settings screen without losing other functionality.

NearBy offers a free tier and a premium subscription ("NearBy Pro") that unlocks additional functionality. The exact feature split between free and Pro may evolve as the App matures; the current split is always shown in the App before purchase.

Subscriptions are billed through Google Play and managed via RevenueCat. Prices are displayed in the App before purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Refunds are handled according to Google Play's refund policies.

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse engineer or decompile the App
• Scrape, crawl, or extract data from our services
• Interfere with or disrupt the App's infrastructure or rate limits
• Impersonate another person or entity
• Upload malicious content or spam
• Use the Assistant to generate harmful, misleading, or abusive content
• Attempt to manipulate the Assistant through prompt injection or similar techniques

The App, including its design, code, content, logos, and trademarks, is owned by NearBy and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Place data, photos, reviews, and event listings displayed in the App are sourced from Google's search and maps platforms (Google Places, Google Maps, Google Hotels, Google Flights, Google Events) and are subject to Google's terms of service. AI-generated text in the Assistant is produced on demand and is not a standalone work of authorship by NearBy.

The App is provided "as is" and "as available" without warranties of any kind. We do not guarantee that:

• The App will be uninterrupted or error-free
• Place information is always accurate or up-to-date
• Assistant recommendations are always correct, complete, or current
• Hotel, flight, or event data reflects real-time availability
• The App will meet all your requirements

Always verify important information (opening hours, prices, availability, bookings) directly with the place or provider before visiting or transacting.

To the maximum extent permitted by law, NearBy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, profits, or losses caused by reliance on Assistant output or place information.

We reserve the right to modify these Terms at any time. We will notify users of significant changes through the App or by updating this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law provisions.
